The difficult decision to terminate an employee’s employment has been made. Now what? Dismissing an employee is a tough task that requires careful planning and preparation. Not to mention employers are increasingly expected to conduct themselves in a professional, sophisticated and knowledgeable manner when proceeding with termination of employment. A failure to do so may result in significant damage and exposure to the employer and its reputation, as well as to the dismissed employee and his or her coworkers.

We will address the following:
- An employer’s obligations upon termination: What are an employee’s entitlements, if any, upon the termination of employment with or without just cause? This will include notice of termination or pay in lieu thereof, group benefit continuance, life insurance, etc.
- Termination letters and offers: What should be included (or not included) in a termination letter? What are the advantages and disadvantages of a termination or ‘severance’ package?
- Conducting a termination meeting: We will discuss how to prepare for and conduct a professional meeting. Who should be present? What information should be provided? What if the employee asks for more details?
- Reference letters: Should an employer provide a reference letter? What should a reference letter say or not say? What if the employee is being terminated for cause?
